Agreement To Share Employees

REPRESENTATIVE RESPONSIBILITIES. In return for the profit sharing granted therein, the representative will perform the following tasks: the concept of staff sharing is based on an employment contract signed by an employee and two or more employers. There is therefore an employment relationship between the persons concerned and the worker for all employers. The explanation of the Labour Code characterises the division of workers as a special form of part-time work, in which a worker performs the same work for several employers, as provided for in Article 195 of the Labour Code. In concrete terms, this means that only one job profile is indicated in an employment contract and that all employers can request tasks that fall within the scope of this job description, but not beyond. The parties may determine for which employer the worker must work during certain hours of the working day. Such a configuration is considered part-time work from the employer`s point of view, since none of the workers are employed full-time. CONSIDERING that the company and the representative wish to enter into an agreement under which [PARTNER 1] and [PARTNER 2] share the profits from the sale of the product due to the efforts of the representative, in accordance with the conditions set out therein. THE WHOLE AGREEMENT. This Agreement constitutes the full understanding of the Parties and supersedes all prior oral or written agreements concerning the subject matter annexed thereto. This job-sharing employment contract covers the requirements of a standard Section 1 form.

As of April 6, 2020, there will be new rules, which will have to be included in a written declaration for newcomers, and staff already in place will be able to request a written declaration in accordance with the new rules. This contract meets these requirements and must be made available to the worker or worker before the first day of employment. This sample form describes various shared and individual work tasks that must be performed and coordinated between staff as part of a work-sharing agreement and documents each employee`s agreement.
